1. Acceptance of Terms

By signing up for WildfireNet alerts, texting a keyword to our number, submitting your information on our website, or otherwise using our services, you agree to these Terms & Conditions and our Privacy Policy. If you do not agree, do not use our services.

These Terms constitute a legally binding agreement between you and ROM Technology ("Company," "we," "us," or "our"), operator of WildfireNet.

2. Description of Service

WildfireNet is an autonomous wildfire detection and alert notification service that:

• Monitors NASA FIRMS satellite fire detection data across priority regions
• Monitors EPA AirNow PM2.5 and air quality data
• Sends SMS text message and email alerts when fire or smoke events are detected
• Provides supplemental situational awareness information to subscribers

WildfireNet is a supplemental information service. It is not an official government emergency alert system and should not be relied upon as your sole source of emergency information.

4. Eligibility

To use WildfireNet alerts, you must:

• Be at least 13 years of age (or have parental consent if under 18)
• Be the account holder or have permission from the account holder for the mobile number provided
• Reside in or have interest in monitoring a region covered by WildfireNet
• Provide accurate contact information

5. Consent to Receive Messages

By opting in to WildfireNet SMS alerts, you expressly consent to receive recurring automated text messages from ROM Technology at the mobile number you provide. This consent is not a condition of any purchase. Consent may be revoked at any time by texting STOP.

By opting in to WildfireNet email alerts, you consent to receive wildfire detection and air quality alert emails from ROM Technology at the email address you provide. You may unsubscribe at any time via the unsubscribe link in any email.

6. Accuracy of Information — Important Limitations

WildfireNet uses data from NASA FIRMS satellite systems and EPA AirNow monitoring stations. While we strive for accuracy, you acknowledge and agree that:

• Satellite fire detection data has inherent limitations including cloud cover interference, resolution constraints, and detection delays
• Air quality readings are based on monitoring station data which may not reflect conditions at your exact location
• Alerts may be delayed, missed, or inaccurate due to technical failures, data gaps, or system outages
• WildfireNet is a supplemental tool — it does not replace official emergency alert systems
• You should always monitor official government emergency management channels in addition to WildfireNet

7. Disclaimer of Warranties

WILDFIRENET SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. ROM TECHNOLOGY DOES NOT WARRANT THAT:

• Alerts will be delivered in a timely manner or at all
• Fire detection data will be accurate, complete, or current
• The service will be uninterrupted or error-free
• Alerts will cover all fire events in your region

YOUR USE OF WILDFIRENET IS AT YOUR OWN RISK. ALWAYS FOLLOW OFFICIAL EMERGENCY MANAGEMENT INSTRUCTIONS AND CALL 911 IN AN EMERGENCY.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROM TECHNOLOGY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE WILDFIRENET SERVICES, INCLUDING BUT NOT LIMITED TO DAMAGES ARISING FROM DELAYED, MISSED, OR INACCURATE ALERTS.

ROM TECHNOLOGY'S TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS SHALL NOT EXCEED $100.

9. Indemnification

You agree to indemnify and hold harmless ROM Technology, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of WildfireNet services, your violation of these Terms, or your violation of any third-party rights.

10. Prohibited Uses

You agree not to:

• Use WildfireNet for any unlawful purpose
• Attempt to gain unauthorized access to our systems
• Use our API or services to send unsolicited messages
• Misrepresent your identity or affiliation when signing up
• Interfere with or disrupt the WildfireNet service
• Use WildfireNet data for commercial resale without written permission

11. Intellectual Property

WildfireNet software, code, and original content are the property of ROM Technology and are open-sourced under the MIT License at github.com/jRomBalance/wildfire-response-system. Fire detection data is sourced from NASA FIRMS and EPA AirNow, which are public domain government data sources.

12. Modifications to Service and Terms

ROM Technology reserves the right to modify, suspend, or discontinue WildfireNet services at any time without notice. We may update these Terms at any time. Updated Terms will be posted at this URL with a new effective date. Continued use of WildfireNet after changes constitutes acceptance of updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of Michigan, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Michigan.

14. TCPA Compliance

ROM Technology complies with the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, and CTIA messaging guidelines. Our SMS program is registered with major US carriers through Twilio's A2P 10DLC program. We maintain records of all opt-in consents as required by law.

15. Emergency Services Notice

WildfireNet is NOT an emergency service. If you are in immediate danger from a wildfire or any other emergency, call 911 immediately. Do not rely solely on WildfireNet alerts for life-safety decisions. Always follow instructions from local fire departments, emergency management agencies, and law enforcement.
